Please read these Terms of Service (“Terms”) carefully before using Margin Levers (the “Service”) operated by Margin Levers (“us”, “we”, or “our”). Your access to and use of the Service is conditioned on your acceptance of these Terms.

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Margin Levers is a customer profitability analysis platform that helps businesses understand their customer economics through profitability analysis and AI-powered insights. The Service includes:

• Customer data upload and analysis tools
• Profit curve visualization and segmentation
• AI-generated insights and recommendations
• Export capabilities (CSV, PDF reports)
• Optional benchmarking against anonymized industry data

3. Service Availability

The Service is intended for use by businesses located in the United States. By using the Service, you represent that your business is based in the United States. We do not currently offer the Service to businesses located in the European Union, European Economic Area, or United Kingdom, and we do not knowingly collect data from such businesses.

4. Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party and to notify us immediately upon becoming aware of any breach of security.

5. Subscription and Payments

Subscription Plans

The Service offers various subscription plans with different features and limits. Details of each plan are available on our pricing page. We reserve the right to modify our pricing with reasonable notice.

Billing

Subscription fees are billed in advance on a monthly or annual basis depending on the plan you select. Your subscription will automatically renew unless you cancel it before the renewal date.

Founding beta members who subscribe to the Growth plan retain their subscription price for as long as they remain on the Growth tier, regardless of future price changes to that tier.

Refunds

Growth plan subscriptions include a free trial period (30 days for standard signups; 60 days for founding beta members; 180 days for OSS program members; credit card required to activate). You will not be charged until the trial ends. You may cancel at any time during the trial at no cost. After converting from trial, we offer a 30-day money-back guarantee: if your Profit Curve Analysis does not surface actionable insights you did not already have within 30 days of your first charge, contact us for a full refund. After 30 days from first charge, refunds are provided at our sole discretion.

6. Your Data

Ownership

You retain all rights to the data you upload to the Service. We do not claim ownership of your customer data, financial information, or any other content you provide.

License to Use

By uploading data to the Service, you grant us a limited license to process, analyze, and display your data solely for the purpose of providing the Service to you. This license terminates when you delete your data or close your account.

Data Security

We implement industry-standard security measures to protect your data. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.

Industry Benchmarks

When you save an analysis, we collect anonymized, aggregate performance metrics to provide industry benchmark comparisons. This includes profitability ratios (such as profit concentration, tail weight, and gross profit margin), categorical data (industry and company size tier), and aggregate customer counts. This data contains no personally identifiable information and cannot be used to identify you or your customers. Your contribution enables all users to compare their performance against industry peers.

7. Acceptable Use

You agree not to use the Service to:

• Upload data that infringes on intellectual property rights of others
• Transmit malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to other users' accounts or our systems
• Use the Service for any illegal purpose or in violation of any laws
• Resell, redistribute, or sublicense the Service without our written permission
• Reverse engineer, decompile, or attempt to extract source code from the Service

8. Intellectual Property

The Service and its original content (excluding user-provided data), features, and functionality are and will remain the exclusive property of Margin Levers and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

9. AI-Generated Content

The Service uses artificial intelligence to generate insights, recommendations, and analyses. While we strive for accuracy, AI-generated content:

• Should be reviewed and validated before making business decisions
• May contain errors or inaccuracies
• Is provided for informational purposes only
• Does not constitute professional financial, legal, or business advice

10. Acceptable Use and Fair Use of AI Features

Each subscription is issued to a single named user (“Account Holder”) and may not be shared, resold, or used to provide services to third parties. Team collaboration features allow additional named users to be added to an account, but each team member must be an authorized employee or contractor of the Account Holder's organization and may not share access credentials.

AI-powered features (including executive summaries, action plans, scenario simulations, board decks, and implementation kits) are subject to the monthly usage limits stated in your plan. You may not use automated scripts, bots, or programmatic methods to circumvent these limits or to generate AI outputs at a volume that exceeds normal human usage patterns. Sharing API keys or credentials with parties outside your organization is prohibited and may result in immediate account termination.

We reserve the right to throttle, suspend, or terminate access for accounts that materially exceed their plan limits or that use the Service in a manner inconsistent with these terms, regardless of whether a hard technical limit has been reached.

11. Limitation of Liability

In no event shall Margin Levers, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

12. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, expressed or implied, regarding the Service's operation, accuracy, or availability. We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time through your account settings. Upon termination, we will delete your data in accordance with our Privacy Policy, unless retention is required by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Margin Levers and its licensees, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts of competent jurisdiction.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
